3. The Regulator's guide
The Information Regulator has published a guide on how to use PAIA, under section 10 of the Act. It is available from the Regulator: Information Regulator (South Africa), JD House, 27 Stiemens Street, Braamfontein, Johannesburg, or enquiries@inforegulator.org.za.
4. Records held
| Group | Examples | Available |
|---|---|---|
| Your own records | Your account, entries, orders, consents and the requests you have made | Automatically, from Privacy and data in your account, without a PAIA request |
| Organizer records | An organizer's own agreement, statements, payouts and entry lists | To that organizer, in the organizer panel |
| Company records | Registration documents, financial statements, tax records | On request, subject to the Act |
| Operational records | Policies, procedures, system documentation | On request, subject to the Act |
5. How to request a record
Use the form prescribed by the Regulator, sent to the Information Officer at the address above. Say which record you want, in what form you want it, how we should reach you, and, where the request is for somebody else's record, what right you are exercising and why the record is needed for it.
We answer within 30 days. That period can be extended once, by up to 30 days, and we tell you if it is.
6. Fees
The fees are those prescribed under PAIA. There is no fee for asking for your own personal information. For any other record, we tell you what the fee is before we start and do not begin until it is paid.
7. Grounds for refusal
Access may be refused on the grounds set out in Chapter 4 of the Act, which include somebody else's privacy, commercial information of a third party, legal privilege, and information given to us in confidence. If we refuse, we say which ground we relied on and how to challenge it.
8. Remedies
If you are unhappy with a decision you may complain to the Information Regulator, and after that apply to court. The Regulator's complaint address is complaints.IR@justice.gov.za.
